Pixagogo Privacy Statement
       
Telenet receives (confidential) data as intermediary in the communication flow of communicating parties and stores customer's data upon request. Telenet also processes personal data to enable the performance of its services.

Telenet pays special attention to the privacy of its users and to the confidentiality of their digital data.

To demonstrate its commitment to respecting privacy and confidentiality, Telenet discloses its practices and has them reviewed by a third party auditor.

Confidential Information

Telenet agrees:

Not to access any confidential data unless necessary for the performance of its services and ensure that employees are bound by the same confidentiality obligations.

To keep strictly confidential and not disclose to any person any of the confidential information except as expressly permitted.

To ensure that no other person can have access or gain knowledge of confidential information.

Not to use, in any way, which is not expressly permitted by the disclosing person, any of the confidential information.

To take appropriate technical and organizational measures that are necessary for the protection of confidential information against accidental or unauthorized destruction, accidental loss, as well as against alteration of, access to and any other unauthorized use of confidential information.

Delete permanently data that are stored at Telenet on request of the subscriber 15 days after expiration of the account or immediately after the owner of the confidential information has deleted the data.

Telenet shall consider the following information as strictly confidential:

personal data of subscribers,

data, including photos, that are submitted to Telenet or through Telenet and stored at Telenet,

audit trail records created or retained by Telenet or their auditors,

contingency planning and disaster recovery plans,

business plan,

security measures controlling the operations of the Telenet services

You can manage yourself the level of confidentiality of your photos:

You can make them candidate for the public gallery, shared, protected by a password or private.

If you choose 'candidate for the public gallery' you propose your album for the public gallery of Pixagogo which is accessible by anyone visiting the website.

If you choose 'shared', your album can be accessed without protection by everyone who has the link to it.

If you choose 'protected by a password', your album can only be accessed by people to whom you gave the password that you chose.

If you choose 'private' you only can access the album by login in to the Pixagogo service.

Respect of Legislation

Telenet commits itself to protect the personal data of subscribers and relying parties. Telenet declares to operate within the limits of the Belgian law of December 8, 1992 on Privacy Protection in relation to the Processing of Personal Data as modified by the law of December 11, 1998 implementing Directive 95/46/EC.


Notification

Related to the processing of personal data Telenet has duly notified the Commission for the protection of the privacy where the public register can be consulted at Waterloolaan 115, 1000 Brussels, Belgium. The notification has been registered under N 002209125, 002209224, 002209323.


Categories of Data

Telenet collects and processes the following personal data: financial information (credit card number, expiration date, billing address), identity information (name, e-mail address), security information (digital certificate, password) and information about the services provided to the subscribers. Telenet shall not process personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade-union membership, and data concerning health or sex life.


Time

Financial information and information about the services provided to the subscribers is kept during maximum one year after the last processing of this data.

Data stored upon request of the subscriber are kept during the period agreed between Telenet and the subscriber and until termination of the agreement between Telenet and the subscriber.


Purpose and Consent

By subscribing to the Telenet services, the subscribers explicitly give their consent to Telenet to collect personal data for:

Customer management (follow-up of orders, deliveries, invoicing, communication, logging of actions);

Access authorization (define if and to what extent users have access to the services).

Telenet only collects information explicitly requested and intentionally submitted by the subscriber.

Telenet also collects personal data of communicating parties, which are not subscribers, for the purposes of:

Customer management (communication, logging of actions);

Access authorization (define if and to what extent the third party has access to the services).

Telenet receives the third party's e-mail address via the subscriber or the third party itself.

The subscriber's account is used exclusively by Telenet to enable authentication of the subscriber, to enable the performance of the Telenet services and to adapt the services to the subscriber's needs.

The third party's personal data is used in order to have a minimal authentication of the third party to whom the photos are sent.

Examples of the usage made by Telenet of the personal data of subscribers/third parties:

to validate the subscriber's e-mail address,

to contact the subscriber about the Telenet services,

to authorize access to the accounts and to the photos

Telenet will not sell, share or rent personal data or other received information to anyone, except as stated below:

Telenet may disclose personally identifiable information to administrative or judicial authorities, if legally required.

Telenet may disclose information about Telenet accounts and account usage on a confidential basis to third-party auditors.


Quality

The subscriber has access to the data that Telenet stores about him/her. This allows him/her to ensure the correctness and the completeness of the personal data that Telenet keeps about him. Telenet shall only process data, which are relevant for the purposes described above.


Right of Access

Each person has the right to access and the right to rectify the personal data that Telenet keeps about him. Through his account the subscriber can via the website access his/her personal data and correct them. Third parties can exercise their rights by sending a digitally signed message or via registered mail with their ID card/passport enclosed. Telenet shall respond to the request within five (5) business days.


Transfer to Other Countries

Telenet may transmit personal data to countries outside EU via the Internet if this is necessary for the performance of the services. More particularly this means that photos can be viewed from a location outside EU if allowed by the creator of the photo album.


Mailing List

Subscribers agree to receive service messages related to the Telenet services they use. Optionally the Subscribers can subscribe to the Telenet mailing list to receive commercial communications and/or to receive the Telenet newsletter.


Cookies

A cookie is a small amount of data, which often includes a unique identifier, which is sent to your browser from a web-site's computers and then stored on your computer's hard drive.

Telenet provides cookies for access authorization. This is needed to verify if you are entitled to access your account. If you do not accept these cookies you will not be able to login to the service.


Pixagogo uses third-party advertising companies and advertising networks to serve ads to you on our behalf when you visit our Web site. These companies may use information (not including your name, address email address or telephone number) about your visits to this and other Web sites in order to provide advertisements about goods and services of interest to you. IP Addresses and Log Files

When a web browser or e-mail application requests a web page from another computer on the Internet, it automatically gives that computer the address where the requested information should be sent. This is called the computer's IP address.

When a web page on the Telenet web-site is requested, that request (including the date and time) is logged on the Telenet servers with information including the IP address of the computer that requested the page.

Telenet uses log files for statistics and troubleshooting purposes.

Privacy Officer

Telenet has appointed a privacy officer.

The privacy officer responds to requests related to the protection of personal data and confidentiality of data. The privacy officer ensures the implementation at Telenet of applicable legislation regarding privacy protection in relation to the processing of personal data.

Requests to access and/or rectify the personal data can be addressed to the privacy officer as well as every question related to the processing of the personal data or to confidentiality of data, the security measures taken in this regard and problems which might occur.

Changes

Substantial changes to this Privacy Statement are disclosed on the website 3 months from the effective date of change.

Dispute resolution

The parties related to a dispute involving any aspect of this Privacy Statement shall initially attempt to settle any dispute or breach amicably. In the event of it being impossible to settle any dispute or breach amicably within three months, any dispute of non-financial nature shall be submitted to the arbitration authority of:
